ProShotX (“ProShotX,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information in connection with our websites, applications, and related services (collectively, the “Services”).
1) Scope
This Policy applies to information we collect when you use the Services, contact us, or otherwise interact with ProShotX. It does not cover third-party sites or services that we do not control.
2) Information We Collect
a. Information you provide to us
- Account & Profile: name, email address, password, preferences.
- Uploads & Content: videos, images, audio, comments, and any metadata you submit for analysis or coaching.
- Communications: messages you send to us (e.g., support requests, form submissions), and responses to surveys.
- Billing: payment data is processed by our payment processor(s). We receive limited information (e.g., status, last 4 digits, expiration) but not full card numbers.
b. Information collected automatically
- Usage & Diagnostics: pages viewed, features used, timestamps, referral URLs, and error logs.
- Device & Network: IP address, device identifiers, browser type, OS, screen size, language, approximate location (derived from IP).
- Cookies & Similar Tech: cookies, local storage, and similar tools to keep you signed in, remember settings, and measure performance.
c. Information from third parties
We may receive information from identity, authentication, analytics, or payment providers, and from coaches or partners who work with you through the Services.
3) How We Use Information
- Provide, maintain, personalize, and improve the Services.
- Analyze shooting form, generate insights, and deliver coaching feedback.
- Process transactions, subscriptions, and account management.
- Communicate with you (service updates, support messages, marketing if you opt in).
- Monitor safety, prevent fraud/abuse, and enforce our terms and policies.
- Comply with legal obligations and protect our rights and users.
Legal bases for processing (EEA/UK only): consent, contract performance, legitimate interests (such as improving and securing the Services), compliance with legal obligations, and protection of vital/public interests where applicable.
4) How We Share Information
- Service Providers: hosting, storage, analytics, payment, email delivery, customer support, and security vendors.
- Coaches: when you engage coaching features, relevant content and profile data may be shared with your assigned coach to provide analysis and feedback.
- Legal & Safety: to comply with law, legal process, or governmental requests; to enforce terms; or to protect the rights, property, or safety of ProShotX, our users, or the public.
- Business Transfers: as part of or during negotiations of any merger, sale of assets, financing, or acquisition of all or a portion of our business.
- With Your Direction: when you ask us to share or otherwise consent to sharing.
We do not sell personal information.
5) Your Choices & Controls
- Account: you can update certain profile details in your account settings.
- Marketing: you may opt out of marketing emails via the unsubscribe link. We may still send transactional or service emails.
- Cookies: use browser settings to block or delete cookies; some features may not function properly without them.
6) Data Subject Rights
Depending on your jurisdiction, you may have rights to request access, correction, deletion, portability, or restriction of your personal information, and to object to certain processing. You may also have the right to withdraw consent where we rely on consent.
To exercise these rights, contact us at support@proshotx.ai. We may need to verify your identity (or the identity of a parent/guardian for youth accounts) before fulfilling your request. You also may have the right to lodge a complaint with your local data protection authority.
7) Data Retention
We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary by data type and use case.
8) Security
We employ administrative, technical, and physical safeguards designed to protect information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9) Children’s & Youth Privacy
- The Services are not directed to children under 13 (or the age required by local law). We do not knowingly collect personal information from children under that age without verifiable parental consent.
- Youth Accounts (under 18): require parent/guardian consent during sign-up. Parents/guardians may review, update, or delete the youth’s information, and may withdraw consent at any time by contacting us.
- We limit collection for youth accounts to information reasonably necessary to participate in the Services and disable behaviorally targeted advertising to the extent applicable.
10) Youth/Parent Consent & Preferences
a. Account & Consent Flow
- During registration, a parent/guardian must provide consent and contact information. We may request reasonable steps to verify parent/guardian status consistent with applicable law.
- Parents/guardians can manage the youth’s privacy preferences (e.g., visibility of profile or content, coach sharing) via account settings or by emailing support.
b. Optional Model Training (Opt-In)
- We only use de-identified derivatives of uploaded content to improve models/features if you (or the parent/guardian for youth accounts) expressly opt in.
- Consent can be withdrawn at any time; we will stop future use. Previously trained model weights are not retroactively altered.
c. Media & Likeness (Optional)
- Separate, optional consent may allow ProShotX to use name, image, and likeness (e.g., testimonials/showcases). This is not required to use the Services and can be revoked prospectively at any time.
d. Parent/Guardian Rights
- Parents/guardians may request access, correction, deletion, or account closure for a youth account by contacting support@proshotx.ai.
- We will take reasonable steps to verify the requester’s identity and authority before acting on a request.
11) International Transfers
Your information may be stored and processed in countries other than your own. Where required, we implement appropriate safeguards for cross-border transfers, such as standard contractual clauses.
12) Third-Party Links & Services
The Services may link to third-party websites or integrate third-party tools. Their privacy practices are governed by their own policies, which we do not control.
13) Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the Effective Date and/or providing additional notice as required.
